ARTICLE 1. BUILDING CODE
There is hereby adopted and incorporated by reference, for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use and occupancy, location and maintenance of buildings and structures, the International Building Code, 2006 Edition, as recommended by the International Code Council, such code being made as a part of the ordinances and code of the city as if the same had been set out in full herein, all as authorized and in the manner prescribed by K.S.A. 12-3009 through 12-3012 including any amendments thereto. At least one copy of the International Building Code shall be marked or stamped “Official Copy as Incorporated by the Code of the City of Montezuma,” and shall be filed with the city clerk to be open to inspection and available to the public at all reasonable hours of business. Any person violating any provision of such code shall be punished as provided in section 1-116 of this code.

(a) No permanent building valued at more than One Hundred Dollars ($100) shall be erected, enlarged, or altered within the city without a permit therefor from the City Council. Application for such permit may be made in the office of the City Clerk and will require a plan of the proposed work together with a statement of the purpose for which it is intended to be occupied, estimated cost, owner and occupant, and a complete description of the location. The fee for a building permit shall be Twenty-five Dollars ($25).
(b) Actual construction must begin no later than three (3) months after an application for a Permit has been granted. Completion shall be in eighteen (18) months unless a special extension has been granted by the City Council. The project must conform to all regulations in the Zoning Ordinance.
(c) Any person, firm, or corporation violating any of the provisions of the article shall, upon conviction thereof, be fined in any sum between Twenty-five ($25) and one hundred ($100) dollars. If the project is started before a Building Permit is granted, the fine shall be one hundred dollars ($100).
